A new arbitration timeline finally has been set in regards to Colorado's proposed compact compliance pipeline. A crediting dispute raised by Nebraska also is included in the arbitration process.
Colorado, Kansas and Nebraska issued a joint notice of arbitration two weeks ago, and held an initial meeting with arbitrator Martha Pagel on Monday, March 29.
Motions and briefs, and responses to them, will take place through May, culminating with Pagel issuing a decision on legal motions by May 17.
The trial is to be held July 12-14 (the location has not been announced), and Pagel is supposed to issue a decision by September 30. The states have until November 1 to give notice on whether they accept the decision.
Below is the full timetable.
• March 22-24, 2010 — States issue Joint Notice of Arbitration and execute contracts with the arbitrator.
• March 29, 2010 — Initial meeting/teleconference with arbitrator.
• April 12, 2010 — Submit legal motions and briefs.
• April 26, 2010 — Submit responsive briefs on legal issues.
• May 3, 2010 — Submit reply briefs on legal issues.
• May 17, 2010 — Arbitrator issues decisions on legal motions.
• May 24, 2010 — Colorado and Nebraska submit to the other states their expert reports, all trial exhibits and final witness lists for their responsive cases.
Discovery period begins.
• June 22, 2010 — The defending states submit to the other states their expert reports, all trial exhibits and final witness lists for their responsive cases.
• July 2, 2010 — Colorado and Nebraska submit to the other states their expert reports, all trial exhibits and final witness lists for Colorado's and Nebraska's rebuttal cases.
• July 7, 2010 — Discovery period ends.
• July 12-14, 2010 — Trial
• July 30, 2010 — Submit post-trial briefs.
• September 30, 2010 — Arbitrator issues decision.
• November 1, 2010 — States give notice whether they will accept the decision.
